Según el Artículo 5 del Tratado de la Unión Europea (TUE ), la función de este principio es la de regular el ejercicio de competencias compartidas entre los Estados Miembros y la Comunidad Europea. Esta última sólo va a intervenir cuando los objetivos de la acción pretendida no sean alcanzados de forma suficiente por los Estados Miembros y sí lo sean a nivel comunitario. En este sentido, surge una doble vertiente: Negativa o prohibitiva: impide la intervención comunitaria cuando los estados miembros pueden alcanzar solos los objetivos Positiva o de habilitación: permite la actuación comunitaria cuando los estados no logren los objetivos suficientemente. Por lo tanto, se trata de un principio flexible que permite una doble interpretación entre dos formas opuestas y que distribuye las tareas teniendo en cuenta, por un lado, la naturaleza de la función a lograr y por otro, la pluralidad de sujetos.
