It is defined in Part IX (i.e. section 160) of the Constitution of Spain, and further governed by Organic Laws 2/1979 (a.k.a. Law of the Constitutional Court of October 3, 1979). The court is the "supreme interpreter" of the Constitution, but since the court is not a part of the Spanish Judiciary, the Supreme Court is the highest court for all judicial matters.

El presidente del Tribunal Constitucional de España es la cabeza del Tribunal Constitucional, órgano constitucional que ejerce la función de supremo intérprete de la Constitución. Su figura se encuentra regulada en el «Título IX» de la carta magna —artículo 160—, así como en la Ley Orgánica 2/1979, de 3 de octubre, del Tribunal Constitucional (LOTC), modificado por la Ley Orgánica 6/2007 de 24 de mayo. El presidente, como máxima autoridad del Tribunal, ejerce su representación y preside el Pleno, así como también preside la Sala Primera. Es nombrado por el rey de España a propuesta del resto de magistrados del Alto Tribunal, que lo eligen por mayoría y para un mandato de tres años con posibilidad de una sola reelección. En casos de vacante, ausencia u otro motivo legal, le sustituye el vicepresidente, quien también preside la Sala Segunda. La Presidencia del Tribunal Constitucional, creada por la Constitución de 1978 y siendo efectiva desde 1980, tiene como antecesora directa la Presidencia del Tribunal de Garantías Constitucionales, órgano similar al Tribunal Constitucional y que tuvo como presidentes a Álvaro de Albornoz entre 1933 y 1934, a Fernando Gasset entre 1934 y 1936 y a Pedro Vargas Guerendiain como presidente interino desde 1936 hasta el final de la Guerra civil española. El actual presidente del Tribunal Constitucional es, desde el 23 de noviembre de 2021, el jurista y catedrático de Derecho Constitucional Pedro González-Trevijano Sánchez.

It is defined in Part IX (i.e. section 160) of the Constitution of Spain, and further governed by Organic Laws 2/1979 (a.k.a. Law of the Constitutional Court of October 3, 1979). The court is the "supreme interpreter" of the Constitution, but since the court is not a part of the Spanish Judiciary, the Supreme Court is the highest court for all judicial matters. The president, as the highest authority of the Court, exercises its representation and presides over the Plenary, as well as presides over the First Chamber. The president is appointed by the Monarch at the proposal of the rest of the Court's magistrates, who elect him or her by majority and for a three-year term with the possibility of a single reelection. In cases of vacancy, absence or other legal reason, he is substituted by the vice president, who presides over the Second Chamber. The Presidency of the Constitutional Court, created by the 1978 Constitution and effective since 1980, has as its direct predecessor the Presidency of the Constitutional Guarantees Court, a body similar to the Constitutional Court and which had Álvaro de Albornoz as president between 1933 and 1934, Fernando Gasset between 1934 and 1936 and Pedro Vargas Guerendiain as acting president from 1936 until the end of the Spanish Civil War. The current and 11th president of Court is since November 23, 2021.
