It was established in 1869 as the Bundesoberhandelsgericht (English: Federal Higher Commercial Court) of the North German Confederation and was named Reichsoberhandelsgericht after the establishment of the German Empire in 1871. In 1879, the court was replaced by the Reichsgericht.
