He represented the provincial riding of Toronto Centre in the Legislative Assembly of Ontario from 1999 to 2010, when he resigned to contest the mayoralty of Toronto in the 2010 municipal election. Smitherman is the first openly gay Member of Provincial Parliament (MPP) elected in Ontario, and the province's first openly gay cabinet minister. Smitherman was a candidate in the 2018 municipal election running for Toronto City Council in Ward 13 Toronto Centre which included much of the provincial riding he represented as an MPP. He received 15% of the vote, failing to unseat incumbent Kristyn Wong-Tam who received 50%. Since March 2020 he has been president and CEO of the Cannabis Council of Canada.
